The French singer must repay 30 million euros to the liquidator of the Icelandic bank Landsbanki Luxembourg, confirmed Thursday 14 march the Luxembourgish justice. The interpreter of Farewell my country had been sentenced at first instance in 2014 to repay this sum, a decision upheld on appeal in 2017. "There was a dismissal of the appeal before the Court of Cassation"said Yvette Hamilius, liquidator of the bank Landsbanki Luxembourg.
Enrico Macias, from his real name Gaston Ghrenassia, had borrowed in 2007 the sum of 35 million euros from Landsbanki Luxembourg. But the bank went bankrupt a year later, amid a financial crisis and nationalization of its parent company. A hundred customers of the bank, Enrico Macias, had filed a lawsuit in France for fraud. They criticized the establishment for having mortgage their property against a credit paid partly in cash and partly in the form of financial investments.
"Victim of fraudulent maneuvers"
But in August 2017, the Paris Criminal Court felt that"It does not follow from the record that the borrowers were victims of fraudulent maneuvers", judgment on appeal is expected in Paris for the month of May. "If the court of appeal decides to reform the judgment, it will be necessary to see what impact it could have on the Luxembourg decision"explained Rosario Grasso, lawyer of the Luxembourg liquidator.
Landsbanki Luxembourg was placed in liquidation in 2008 and is now trying to collect the debts. Yvette Hamilius has already recovered 2,2 billion euros on a total liability of 2,5 billion euros.
